The Third Circuit Court of Appeal ruled today that statements Seth Fontenot made following the shooting death of a Lafayette teenager can be used in his trial.

According to our news partners at KATC, Fontenot's attorney argued that his client's statements to police shouldn't be used because he was only told halfway through questioning that 15-year-old Austin Rivault died from shooting injuries.

Judge Kristian Earles ruled in September that his statements could be used in trial, and the Court of Appeals upheld the decision this week.

Fontenot's trial is set for Nov. 12. He's accused of killing Rivault and shooting two other teens in February.
