The Alabama man who allegedly committed sexual battery in that now infamous video following the BCS National Championship Game is being sued. The LSU fan filed a lawsuit Friday against Brian Downing of Smiths Station, Alabama.

The lawsuit does not specify a dollar amount but does say the unnamed LSU fan suffered "mental anguish, humiliation, embarrassment, anxiety and depression ... damage to reputation" and lost tuition payments "for having to withdraw from school."

32-year-old Downing was booked in January on charges of sexual battery and obscenity but the New Orleans district attorney has yet to decide whether to prosecute. The D.A.'s office has until June 20 to decide whether or not to do that.
