Berry Battles for Custody

Divorce and break-ups are tough on those that are involved, but especially tough on the kids. It hurts me to think that just because Mom and Dad can't get along that innocent little ones have to suffer to. It doesn't matter whether you're an average John or Jane Doe or a high profile celebrity the battle for custody and care of children in cases of divorce or break-up almost always turns bitter and results in hurt feelings. Halle Berry, the actress is finding that out in a very personal way.

After hearing arguments this morning from both sides -- as Halle looked on -- the judge gave her the green light to travel to New York with her kid. We've learned she won't take back the role that was given to Katherine Heigl, but she'll play another character in the movie.
