FAA Proposes Waivers To Environmental Laws For Space Launches

(KMDL-FM) Did the Federal Aviation Administration just make a statement about the potential for spaceflight launches and reentry licenses in Louisiana without saying that they were requesting rule changes for spaceflight, et al in Louisiana?

Since the FAA is a government agency, it's pointless to attempt to read between the lines with any degree of certainty, but we're going to do it anyway because if this "smoke" leads to "fire," it could impact one of the most important resources Louisiana has, namely our wild and natural wetlands and marshlands.

Why Is The FAA Requesting Environmental Law Changes for Spaceflights?

Before we go too far down the rabbit hole and allow speculation to run rampant, let's qualify what we know. We do know the FAA has requested rule changes that would waive certain environmental requirements as they pertain to space launches and to reentry and recovery of spaceflight vehicles.

We do know that, under the request made by the FAA, 13 federal environmental laws would be subject to the actions of any proposed waiver. Among the environmental rules that would be subject to "bending," for lack of a better term, are the Clean Air Act, the Clean Water Act, the Endangered Species Act, and the Coastal Zone Management Act.

The Proposed Waiver Changes Cover More Than Clean Air and Water Concerns

The proposed rule changes, if granted, would also affect historic preservation programs, marine mammal programs, fisheries and marine sanctuaries, as well as protection for rivers and harbors.

It should be noted that the requested rule changes do not automatically waive or suspend stipulations set forth by these acts and rules; however, the rule variance would allow each situation to be studied and evaluated in a more specific way.

We do need to reiterate that, as of now, this is simply a request for changes to existing rules and regulations by the FAA; nothing should be confirmed, nor should it be implied, but it does seem to be a very convenient coincidence that SpaceX is rumored to be contemplating construction in Vermilion Parish, Louisiana.

The part of Vermilion Parish where SpaceX is alleged to be considering just happens to be wetlands, marshes, and swamps inhabited by endangered creatures who thrive on clean air and water.

Apparently, if we are reading the tea leaves correctly, residents of South Louisiana are going to have to decide the future. Do we maintain and hold closer what we hold dear, or do we expand our horizons and hope that technology and the environment can co-exist synergistically?
