McDonald’s Pays $800,000 After 4-Year-Old Burned By Hot Nugget

A Fort Lauderdale jury has awarded a Florida family $800,000 in a lawsuit claiming that "unreasonably and dangerously" hot chicken nuggets left their 4-year-old daughter with second-degree burns.

Hot Chicken Nugget McDonald's Lawsuit

Philana Holmes and Humberto Caraballo Estevez, parents of Olivia Caraballo, filed a lawsuit against McDonald's Corporation and the franchisee Upchurch Foods, Incorporated, after the couple claims a scorching hot chicken nugget caused second-degree burns to the couple's 4-year-old daughter.

The family claimed that a McNugget got stuck in the girl's car seat and severely burned the girl's leg.

On Wednesday (7/19/23) a Fort Lauderdale, Florida jury ruled in favor of the couple and awarded Holmes and Humberto $800,000.

According to NBCMiami.com, after deliberating for two hours over how much the family should be awarded for the child's pain and suffering, the jury reached their decision of $800,000.

The family was suing for $15 million.

Attorneys deemed the $800k as a fair judgment.

"Both McDonald's and Upchurch argued during the trial they were not at fault, but the Broward jury found McDonald's and Upchurch failed to put warnings on the food and that led to the child's injury.

But McDonald's was found not negligent for causing the burns."
